Appellate Law - April 2026

Preserving Issues for Appeal

One of the most important concepts in appellate law is preservation. To raise an issue on appeal, it generally must have been raised and ruled on at trial.

This means that objections must be made at the right time, and legal arguments must be presented to the trial court. Failing to preserve an issue can bar appellate review.

Trial counsel and appellate counsel should work together to ensure that issues are properly preserved for appeal.
